Roadside Memorials (92 Ill. Adm. Code 549)
The Department is proposing minor amendments to this part to reflect changes made to the Roadside Memorial Act (605 ILCS 125) by P.A. 102-0982 and P.A. 103-0082. The changes include replacing “fatal accident” with “fatal crash” per P.A. 102-0982 and replacing memorial marker and commemorative plaque maintenance time by the Department from 2 years to 4 years per P.A. 103-0082. One-time fee increases from $150 to $200 for each DUI or fatal crash memorial marker, from $50 to $75 for each commemorative plaque, which is necessary to offset the actual cost of fabrication of the marker and plaque.
The proposed changes are published at Issue 51, 49 Ill. Reg. 15937, December 19, 2025; The Department will be accepting written comments on the proposed rulemaking through February 1, 2026. Comments may be submitted to DOT.AdminRules@Illinois.gov.
